Can the strata ban election signs?

It’s Federal election time here in Canada, and we see Liberal, Conservative, and NDP signs popping up all over the place! It’s great that Canadians are asserting their democratic right to vote, but what happens when your Strata takes issue with your signage?

Well, first and foremost, the Strata Corporation has to follow the Federally legislated Elections Act, which allows all Canadians to post signage during the election period. This legislation will trump the Strata Act and your strata bylaws!

What CAN the strata corporation do about election signage

Strata Bylaws CAN dictate the size and style of signage to avoid an arms race (who’s sign is bigger), and can also block signage from being displayed on common property! These bylaws must be reasonable, and not contravene the elections act, but they cannot prevent owners from posting signage within their own private strata lots!

Keep in mind that the strata also cannot block access to canvassers during election period between the hours of 9am-9pm!
