Now that the 2021 Federal election is upon us, you may be wondering if election signs are allowed. Many strata corporations have bylaws that prohibit, or severely restrict the posting of signage within the strata lot or on common property.
Fortunately for democracy, Strata Corporations cannot prohibit an owner or tenant from displaying elections signs.
The Canadian Elections Act Section 322 supercedes any, and all Strata Corporation bylaws preventing the display of elections signs within strata lot property.
Having said that, Strata Corporations CAN limit the size or type of posters that are allowed to be displayed with the individual strata lot.
They can also prohibit the display of election posters within common property.
The strata corporation also cannot limit election candidates from accessing the building to campaign or canvass between the hours of 9am and 9pm.
